Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

For a lot of veterans suffering from disabilities caused by their military service, a veterans disability lawsuit may be the answer. The Department of Veterans Affairs offers benefits to veterans, such as medical care and special programs.

According to a lawsuit filed on Monday, Black veterans have disproportionately more difficulty receiving these benefits. The Yale Law School Veterans Legal Services Clinic filed the suit on behalf of Conley M. Monk Jr.

PTSD

PTSD symptoms can manifest when someone is traumatized. It can manifest as panic, nightmares, flashbacks or other symptoms that are disturbing. The condition may also cause someone to avoid certain locations or situations that trigger the trauma. This can lead people to feel lonely and depressed. Therapy, medication, and support from family members can help to treat PTSD.

A new lawsuit brought jointly by Black manistee Veterans Disability law firm and Yale law clinics revealed that the Department of Veterans Affairs denied disability compensation claims made by Black veterans consistently over the course of decades. Quil Lawrence of NPR reports that a VA whistleblower revealed to the veterans that VA documents showed that Black picayune veterans disability law firm were denied benefits in a higher proportion than their white counterparts.

The lawsuit was filed by Marine Vietnam veteran Conley monk and Yale's Veterans Legal Services Clinic. The lawsuit cites research that indicates that from 2001 until 2020, the rate of rejection for Black disability claims was 29.5 percent, compared with 24.2% for white veterans.

The lawsuit seeks compensation for Monk and other Black veterans who were unfairly denied access to benefits. The lawsuit also seeks to make VA to review tens or thousands of other claims which were wrongly denied. The lawsuit was filed in federal court on Wednesday.

Traumatic Brain Injury

TBI symptoms can be present immediately or appear for days, hours or even weeks later. Some symptoms are physical (headache dizziness, fatigue and headache) while others may be related to issues with memory, concentration, emotions or behavior. TBIs can vary in severity, ranging from concussion to coma. Patients with TBIs are at an increased risk of developing depression and PTSD, as well as other mental health problems. Research suggests that having multiple moderate to severe TBIs could increase the risk of dementia and movement disorders later in life.

Post Traumatic Stress Disorder

Post-traumatic stress disorder (PTSD) occurs when a person experiences a trauma. Symptoms can start at the time that the event is over and continue for a long time. Memory issues, trouble in sleeping and concentrating, feelings of anger or irritability as well as being easily shocked are some of the signs. Some people may experience depression or suicidal thoughts. The PTSD condition can cause issues at work, in relationships, and at home. It can also cause alcohol or drug addiction.

Psychotherapy can treat symptoms such as eye movement desensitisation (EMDR) and cognitive processing therapy. Some people suffering from PTSD benefit from taking antidepressants such as selective serotonin reuptake inhibitors or SNRIs. It is crucial to visit a doctor if you have PTSD. Symptoms that interfere with everyday life, like difficulty relating to others or feeling angry and annoyed should be addressed immediately. Some people with PTSD benefit from self-help which includes talking about their experiences in therapy or using relaxation techniques like deep breathing or doing a thumping exercise. They may also gain by being able to discuss their fears with a person they trust.

Depression

Depression can lead to feelings of despair or sadness. It can be treated with psychotherapy, which involves talking with an experienced therapist about the issues which are causing you issues. The lawsuit was filed on behalf of Conley Monk who is a Vietnam War veteran who tried to get medical benefits including housing assistance, education and benefits for 50 years. The suit is being filed by Yale Law School's Veterans Legal Services Clinic, which represented Monk in his successful fight to rescind his less-than-honorable discharge due to PTSD and other injuries.

The lawsuit claims that racial bias within the justice system of the military affected the discharge status of many Black service members and VA officials should have recognized this prior to making disability compensation decisions. The lawsuit cites a study which found that between 2001 and 2020, the average denial rate for Black hendersonville veterans disability attorney who applied for disability compensation was 29,5%, compared with 24,2 percent for white veterans.
